Data Services

Verizon Wireless charges you for all data sent or received using our network, including any network overhead associated with content sent or received. Sending or receiving data using a virtual private network (VPN) involves additional VPN overhead for which you will be charged. Please note that certain applications or widgets periodically send and receive data in the background, without any action by the user, and you will be billed for such data use. Applications may automatically re–initiate data sessions without your pressing or clicking the SEND or connect button. Data sessions automatically terminate after 24 hours. A data session in inactive when no data is being transferred. Data sessions may seem inactive while data is actively being transferred, or may seem active when the data is actually cached and data is not being transferred. If you have a Data Only plan and use voice service, domestic voice calls will be billed at $0.25/minute.

We are implementing optimization and transcoding technologies in our network to transmit data files in a more efficient manner to allow available network capacity to benefit the greatest number of users. These techniques include caching less data, using less capacity, and sizing the video more appropriately for the device. The optimization process is agnostic to the content itself and to the website that provides it. While we invest much effort to avoid changing text, image, and video files in the compression process and while any change to the file is likely to be indiscernible, the optimization process may minimally impact the appearance of the file as displayed on your device. Data transfer amounts will vary based on application. If you download an audio or video file, the file may be downloaded in sections or in its entirety; data charged will apply to the portion downloaded, regardless of whether you listen to or watch all of it. You may access and monitor your own data usage during a particular billing period, including during the Return Period, by accessing My Verizon online or by contacting Customer Service.

Prepaid Mobile Broadband Tablet Plans automatically renew each month on the same calendar day as the original purchase (if the purchase was made on days 29–31, the renewal date is the 1st of the following month), and the customer’s credit card is billed accordingly. If the entire data allowance is used before the renewal date, service will not be available until the plan automatically renews, unless a new data plan is purchased. If a new data plan is purchased, the automatic renewal date is adjusted according to the new purchase date.

Check Approximate Data Usage

(There will be a time lag between the end of a data session and the point at which the usage will appear on any of these tools.) You can check your approximate unbilled monthly data usage for your Mobile Broadband device through the following options:

Monthly Plans

Click the VZAccess Manager “Usage” button. (Customers must download the most recent version of VZAccess Manager from vzam.net for this capability. For Windows, version 6.7 or higher. For Mac OS X, version 4.0 or higher. When using Intelligent Mobile Hotspot, you must connect with the included USB cable to check your usage in VZAccess Manager.)

Log on to My Verizon or My Business Account.

Dial 1.800.922.0204, then enter Mobile Broadband device wireless number.

Prepaid Plans

Click the VZAccess Manager “Usage” button. (Customers must download the most recent version of VZAccess Manager from vzam.net for this capability. For Windows, version 6.7 or higher. Data Services: Permitted Uses

You can use our Data Plans and Features for accessing the Internet and for such things as: (i) Internet browsing; (ii) email; (iii) intranet access (including accessing corporate intranets, email and individual productivity applications made available by your company); (iv) uploading, downloading and streaming of audio, video and games; and (v) Voice over Internet Protocol (VoIP).

Data Services: Prohibited Uses

You may not use our Data Plans and Features for illegal purposes or purposes that infringe upon others’ intellectual property rights, or in a manner that  interferes with other users’ service; that violates trade and economic sanctions and prohibitions as promulgated by the departments of Commerce, Treasury or any other U.S. government agency; that interferes with the network’s ability to fairly allocate capacity among users or that otherwise degrades service  quality for other users. Examples of prohibited usage include: (i) server devices or host computer applications that are broadcast to multiple servers or recipients such that they could enable “bots” or similar routines (as set forth in more detail in (ii) below) or otherwise degrade network capacity or functionality; (ii) “auto-responders,” “cancel-bots,” or similar automated or manual routines that generate amounts of net traffic that could disrupt net user groups or email use by others; (iii) generating “spam” or unsolicited commercial or bulk email (or activities that facilitate the dissemination of such email); (iv) any activity that adversely affects the ability of other users or systems to use either Verizon Wireless’ services or the Internet-based resources of others, including the generation or dissemination of viruses, malware or “denial of service” attacks; (v) accessing, or attempting to access without authority, the information, accounts or devices of others, or to penetrate, or attempt to penetrate, Verizon Wireless’ or another entity’s network or systems; or (vi) running software or other devices that maintain continuous active Internet connections when a computer’s connection would otherwise be idle, or “keep alive” functions, unless they adhere to Verizon Wireless’ requirements for such usage, which may be changed from time to time.Customers who do not have dedicated Mobile Broadband devices cannot tether other devices to laptops or personal computers for use as wireless modems unless they subscribe to Mobile Broadband Connect. We further reserve the right to take measures to protect our network and other users from harm, compromised capacity or degradation in performance. These measures may impact your service, and we reserve the right to deny, modify or terminate service, with or without notice, to anyone we believe is using Data Plans or Features in a manner that adversely impacts our network.

We may monitor your compliance, or other subscribers’ compliance, with these terms and conditions, but we will not monitor the content of your communications except as otherwise expressly permitted or required by law. [See russellcellular.com/store/privacy]

Global Email / Global Access

Verizon Wireless will terminate your service for good cause if less than half of your usage over three consecutive billing cycles is on the Verizon Wireless National Enhanced Services Rate and Coverage Area. Placing your GlobalEmail SIM in any other non-BlackBerry or smartphone device could result in additional charges or termination of service.

Global Email, Global Access & Global Phone SIM Cards

Your SIM Card is for use only with your Global PC Card, Global smartphone or Global Phone, and only for the purpose of those services. You are responsible for any unauthorized use of your SIM Card, and will safeguard security codes. Upon termination of your service, please destroy your SIM Card.

My Verizon Terms and Conditions

Customer Agreement

Your use of My Verizon and any My Verizon services is subject to the terms and conditions of your customer agreement, including the dispute resolution provisions.

Password/Personal Identification Number (PIN)

You are solely responsible for maintaining the confidentiality of your password and/or PIN code. If your password or PIN code is lost, stolen or used without your permission, call Verizon Wireless immediately at 1-800-922-0204.  If you disclose your password or PIN to a third party bill payment vendor, Verizon Wireless nor Russell Cellular is not responsible for the accuracy and timeliness of your bill payments.

You consent to delivery of PIN codes by text message to your wireless phone unless Verizon Wireless determines that your wireless phone is not capable of receiving text messages.

Paperless Billing

You may enroll in paperless billing through My Verizon, which means you will no longer receive a paper bill and you accept the presentation of your bill online through My Verizon or by email.

Trademarks

You may not use any Russell Cellular and or Verizon Wireless trademarks or service marks without Verizon Wireless’s prior written permission from each entity

US Export Laws

Your use of Verizon Wireless online services is subject to U.S. export control laws and regulations. You represent that you are not a citizen of an embargoed country or prohibited end user under applicable U.S. export and anti-terrorism laws, regulations and lists. You will not use, export or allow a third party to use or export Verizon Wireless online services in any manner that would violate applicable law, including but not limited to applicable export control laws and regulations.

Verizon Wireless nor Russell Cellular makes no guarantee that communications or transactions conducted online will be absolutely secure or free from harmful components. There may be times when service is unavailable. Verizon Wireless provides no warranties of any kind, either express or implied, including, but not limited to warranties of title, non-infringement or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by Verizon Wireless, its affiliates or their respective employees shall create any warranty hereunder. Verizon Wireless is not responsible for any damages incurred, consequential or otherwise.

Worry Free Guarantee

Year in and year out, Verizon Wireless continues to win awards for its reliable service and powerful performance. In the latest Root Metrics network report, Verizon’s network won or shared first place in all 6 categories tested, including overall network performance, reliability, speed, data, call and text.

In-Store Pickup (ISPU) Returns and Exchanges

ISPU orders can be returned to the store location where it was picked up, at any corporate store, or through Verizon Customer Care and sent back to the warehouse. ISPU orders cannot be exchanged in Russell Cellular stores or any other indirect retailers. If you need to complete an exchange, you can process the exchange through Verizon Customer Care or by visiting a corporate store. The Verizon return/exchange policy and restock fee(s) applies to all ISPU orders.

Exchange New Merchandise / Device Exchange Program

Within 30 days of purchase of new merchandise, you may exchange it one time. In order to make the exchange, return the merchandise (including phone, charger, battery, instructions, etc.) in its original box. All merchandise must be in like-new condition. Please have your customer receipt available as proof of purchase. A $50 Restocking Fee will apply to all Phones, Tablets, and Connected Devices. Each invoice will reflect the Restocking Fee for devices. If you’re having a problem with your device, contact Verizon Wireless Technical Support toll-free at 1.866.406.5154 from a landline phone and they’ll diagnose the issue. If they cannot resolve the problem while you’re on the line, and the problem is caused by a manufacturing defect within the first year you own the device, they’ll send you a Certified Like-New Replacement (either a like unit or one of comparable quality) right to your door at no cost to you. If you call them after the return and exchange period, the device you receive may be reconditioned equipment. Certified Like-New Replacements will carry the remaining warranty period from the original device, or 90 days, whichever is greater. Devices subject to neglect, misuse, liquid damage, unreasonable wear and tear and the like, are not eligible for any return or exchange program. This program does not cover devices on Prepaid Accounts, or lost or stolen devices.

Any fully-functioning, like-new Apple product may be returned or exchanged within the guidelines and conditions of the return and exchange policies. Should an Apple product malfunction at any time after the device is initially sold, contact Apple Care at 1.800.275.2273. Apple is solely responsible for the warranty and technical support of all Apple products.

Upgrade Policy

(Policy Change as of 04/09/2021) Verizon Wireless is implementing a $35 Upgrade/Activation Fee. The Upgrade/Activation Fee is charged when upgrading or activating a new device at a discounted rate. This applies to 2-year contracts and device payments. There is a one-time charge to cover increasing costs associated with upgrading to new equipment. Devices are more sophisticated than ever before, and we provide many services which include Wireless Workshops, online educational tools, and consultations with experts who provide advice and guidance on devices.Additional services we provide, for a low setup fee of $35, are backing up your contacts, email and voicemail setup, demos, as well as ensuring any apps, music, pictures, and videos remain accessible from your new handset.While the upgrade fee is not unique to Verizon, our fee is over 15% lower than our two largest competitors, and most devices can be traded in with our “green friendly” trade-in program, which is another way you may save on your upgrade and potentially offset the fee completely. Ask your sales representative for details.The Upgrade Fee does not apply to Business Customers with 11 or more lines, Prepay customers, Insurance replacements, or Upgrades that do not extend the contract.If the device is returned within 3 days, the Upgrade Fee is automatically credited off the monthly statement, or refunded, depending on how the fee was originally charged.

Refunds / Exchanges / Restocking Fee

We will gladly accept returns or make exchanges on merchandise purchased from Russell Cellular within 30 days of purchase. Some products may not be returned, or will need to be replaced by the original manufacturer for warranty. Check the comments included on your invoice for additional information.At our discretion, we may decline your return or charge you a fee for a missing item. Fees may be changed for items that we determine are damaged or require service, or for items that we cannot certify as new equipment. Cash paying customers will be refunded cash if the purchase is $50 or less, unless it is the same day as the original cash purchase. Credit card will be refunded by credit card, or refund check respectively. All cash refunds above $50 will be refunded by refund check.If you received a discount based on the purchase of an item (i.e. “$100 Free Accessory Promo” or similar offer), the return of that item will result in the forfeit of the discount, which may be deducted from any refund amount or charged back to the customer upon return. All sales are final on screen protectors, all headphones, and Setup for Success Fee.

Gift Cards
A Gift Card may only be used for purchases at Russell Cellular stores and cannot be redeemed for cash.

Pricing Policy

All pricing on mobile phones and/or internet devices displayed are based on a monthly Device Payment Installment Agreement with Verizon except where otherwise indicated. All mobile phones and/or internet devices may be purchased “un-activated” for MSRP. Russell Cellular will match any local, non-internet Verizon price for any device activated on a 2-year service agreement within 30 days of purchase with proof of lower price.

Existing Verizon Account Information

By submitting an order for the purchase of mobile phones and/or internet devices, and by providing your existing Verizon account information to Russell Cellular, you expressly agree that you are authorizing and granting Russell Cellular permission to verify, access and review your existing Verizon account in connection with the prospective purchase.

Online Payment

When submitting an order for purchase online, you must ensure that your transaction is correct before submitting your payment. By clicking the “Submit Button” on the Order Summary page, you are agreeing to the Order Total amount listed on the page. You are also approving Russell Cellular/Verizon Wireless to authorize and charge your credit/debit card or other payment method listed on the page.

Terms of Sale

Russell Cellular reserves the right, at its sole discretion, to limit, prohibit, refuse or cancel an order or purchase for any reason and at any time. For example, we may limit, prohibit, refuse or cancel your order or purchase: (i) if there is an ongoing dispute concerning payment of a prior order or purchase; (ii) if we suspect that you have engaged in, or are engaging in, fraudulent activities; (iii) if you have violated any of these Terms & Conditions; or (iv) for any other reason.
